The Nigerian Bar Association (NBA), Owerri branch, has made it abundantly clear that the appointment of the acting Chief Judge of Imo State must adhere to due process. In a recent statement issued by the branch's chairman, Chief Chris Ihentuge, and secretary, Daniel Odiba, the NBA underscored the importance of following established constitutional guidelines in judicial appointments.
The controversy arose following the recent appointment of Justice Theophilus Nzeukwu, the fourth in the judicial hierarchy, as the acting Chief Judge by Governor Hope Uzodimma. The NBA expressed concerns that if the most senior judges were overlooked, there must be a compelling and transparent justification for such a significant deviation.
The association emphasized, “If there exists any impediment preventing the senior judges from assuming the role, such an impediment, if valid, should not only disqualify them from the position of Acting Chief Judge but also from sitting as judicial officers.” This statement highlights the NBA's commitment to ensuring that the integrity of the judiciary is upheld.
As key stakeholders in the legal profession, the NBA insists that clarity on the reasons behind the Governor's decision is crucial. They believe that without this clarity, they cannot, in good conscience, accept the appointment. The association is urging the governor to promptly address the situation and consider reversing the decision, which they deem inconsistent with constitutional provisions.
The NBA warned that failure to adhere to due process could further erode public confidence in the judiciary, especially at a time when faith in Nigerian institutions is already waning. “The Bar shall take all necessary steps in the circumstance,” they asserted, indicating their readiness to advocate for accountability.
It’s important to note that the NBA, Owerri Branch, is not advocating for any individual to be appointed as Chief Judge; rather, they are firmly committed to the protection of due process, the rule of law, and the sanctity of the Constitution.
